    Business Formation

    FOUNDATION

Register your LLC or corporation with the California Secretary of State. Get your EIN, open a business bank account, and register with the Employment Development Department (EDD) and Franchise Tax Board.

  2. 2

    Surety Bond & Insurance

    INSURANCE

Get your $25,000 surety bond (required by AB 1217), employee dishonesty bond, general liability insurance, and workers' compensation. California's insurance requirements are among the most strict in the country — start early as these can take time.

  3. 3

    Policies, Procedures & Training Programs

    POLICIES

Write your policies covering client rights, abuse prevention, incident reporting, HIPAA, emergency preparedness, personnel management, and caregiver training. These must follow AB 1217 and CDSS rules. You also need an organizational chart and designated administrator plus an alternate.

  4. 4

    Submit HCO Application

    APPLICATION

The full application packet is about 60 pages with multiple forms. It must be printed, mailed to CDSS with a paper check — there is no online submission. This is the most complex state application in the country. Make sure everything is accurate before mailing.

  5. 5

    Live Scan & CDSS Orientation

    SURVEY

After CDSS receives your application, they will direct all owners to complete DOJ and FBI fingerprint background checks at a Live Scan location. Owners must also attend a mandatory online orientation class hosted by CDSS (scheduled roughly every 3 weeks). Your application is then reviewed by an analyst and sent to a supervisor for final approval.

  6. 6

    License Issued & Begin Operations

    OPERATIONS

Once approved, your HCO license is valid for 2 years. Register caregivers on the Home Care Aide Registry (all must have completed Live Scan before providing services). Expect an unannounced survey from CDSS at some point after your license is issued. You can start from home or an office.

Common Questions Before You Book

How long does it take to get an HCO license in California?

Typically 3 to 6 months from when you mail your application to CDSS. The timeline depends on how complete your application is, how fast background checks process, and CDSS workload. Starting your surety bond and caregiver background checks early helps avoid delays.

Do I need a Certificate of Need to start a home care agency in California?

No. California does not require a Certificate of Need for home care agencies. This is a big advantage over states like New York, Florida, and Georgia, where the CON process can add 6-24+ months to your timeline.

What is the $25,000 surety bond?

AB 1217 requires all Home Care Organizations to maintain a $25,000 surety bond to protect consumers. If your agency breaks state rules, clients can recover damages through the bond. You can usually buy it for an annual premium of 1-10% of the bond amount, depending on your credit.

Can I operate a home care agency from home?

Yes. No nurses are required for the HCO license, and you can start from home. Many owners start at home to save on overhead. Just make sure you have a dedicated space for records and meet local zoning laws.

Do I need a nursing degree to start?

No. You need a designated administrator and an alternate administrator, but no nurses are required for the HCO license. You do need to complete the 40-hour Administrator Certification.

What is the In-Home Supportive Services (IHSS) program?

IHSS is California's largest publicly funded home care program, serving 600,000+ people through Medi-Cal. While clients often hire their own caregivers, HCOs can offer administrative and management support services. You need licensure to access third-party payers like Medicaid and VA.

What are the biggest challenges of starting in California?

The high cost of entry ($25,000 surety bond, strict insurance requirements, elevated wages), navigating California's complex labor laws (overtime after 8 hrs/day, mandatory breaks), recruiting in a competitive market, and the 60-page paper-only application process. But California's massive market size and strong private-pay demand make it one of the most rewarding states for well-run agencies.

California Home Care Licensing: What You Need to Know

California regulates non-medical home care under the Home Care Services Consumer Protection Act (AB 1217), enacted in 2016. To operate, you must get a Home Care Organization (HCO) license from CDSS. This license covers the full scope of non-medical services: personal care, companionship, homemaker services, and help with daily activities. Caregivers can also help clients with self-administration of medications — like opening bottles, bringing prescriptions, or setting up pill organizers. No nurses are required for this license. California does not require a Certificate of Need (CON), so there is no extra waiting period to enter the market.

The Home Care Organization (HCO) License

Average billing rates of $30-$45/hour depending on the county. Strong private-pay demand from affluent retirees and dual-income families. AB 1217 requires all HCOs to maintain a $25,000 surety bond for consumer protection. Annual premium is typically 1-10% of the bond amount. All caregivers must complete fingerprint-based background checks through the California DOJ and FBI Live Scan system and be registered on the CDSS Home Care Aide Registry before providing any services. California also requires 40-hour administrator certification (typical cost $300 - $800).

Certificate of Need (CON) in California

No CON Required. California does not require a Certificate of Need for home care agencies. This is a big advantage over states like New York, Florida, and Georgia where CON adds 6-24+ months to the timeline.

Medicaid Participation — In-Home Supportive Services (IHSS)

California's largest publicly funded home care program, serving 600,000+ recipients through Medi-Cal. You need licensure to access third-party payers like Medicaid and VA.

Common Reasons California Applications Are Rejected or Delayed

  • Generic P&P manuals that don't reflect state-specific regulations
  • Incomplete administrator documentation
  • Insurance or surety bond policies that don't meet state minimums
  • Missing or inadequate quality assurance program documentation
  • Physical office that doesn't meet site-review standards
  • Caregiver background checks that miss required state databases

Every one of these is preventable with proper preparation. It's the biggest reason founders choose done-for-you packages over DIY — the cost of a rejection in lost time is almost always higher than the cost of doing it right the first time.
